A Plea for Justice: Stand Against Unfair Laws

Dear Brothers,

I write to you as a man who has suffered deeply under the weight of unjust laws. Laws that strip us of dignity, dehumanize us, and reduce us to nothing more than financial providers. I am not alone in this struggle—countless men across the nation endure the same fate.

We are not asking for favoritism. We are asking for fairness. The current system is outdated and unjust, and it needs to change.

Let us boldly declare:

No Maintenance

No Alimony

The Reality: Misuse of Laws

Here are examples of real-life cases where men have endured extreme injustice under the current system:

  1. Adultery and Alimony: In the case of Sachindra Nath Biswas vs. Sm. Banamala Biswas And Anr.(Case), the husband sought divorce on grounds of the wife’s adultery. Despite the allegations, the court granted the wife alimony pendente lite, highlighting that even in cases of alleged adultery, maintenance could be awarded.
  2. Age of Marriage: In another case, a marriage lasted barely one month. The wife walked out, citing vague reasons, and later filed for maintenance despite being well-educated and earning a higher salary than the husband. The court, however, ordered the man to pay, citing “marital responsibility.”
  3. Wife Earning More: A software engineer earning ₹50,000 per month was forced to pay maintenance to his wife, who was earning ₹80,000 per month. The court justified its decision by claiming that the man’s income gave him a “higher capacity to pay.”
  4. False Domestic Violence Case: A man was falsely accused of domestic violence after filing for divorce due to irreconcilable differences. The case dragged on for years, during which he had to pay maintenance despite no evidence of violence being found.
  5. Father Denied Custody and Financially Drained: A father, who was the primary caregiver to his child during the marriage, lost custody despite evidence of his wife’s neglect. He was ordered to pay exorbitant child support, leaving him financially drained and emotionally shattered, while being denied visitation rights.

    What We Demand

    1. Abolish Mandatory Maintenance: The law must end the blanket assumption that men should always pay maintenance. Each case should be judged on merit, considering the earning potential, responsibilities, and circumstances of both parties.
    2. End Alimony Exploitation: Alimony laws must be revised to reflect equality, ensuring they are not used as a tool for exploitation. The principle of self-reliance must apply to both parties.
    3. Time-Bound Settlements: Divorce and maintenance cases should be resolved within a maximum of six months to prevent prolonged emotional and financial harassment.
    4. False Allegations Should Be Punished: There must be strict penalties for filing false cases of domestic violence, dowry harassment, or other marital disputes. Such cases waste time, resources, and lives.
    5. Shared Responsibility for Children: Custody and child support laws should ensure both parents share responsibilities equally, financially and emotionally. Fathers must not be alienated from their children.
    6. Protect Men’s Mental Health: Establish support systems and legal aid for men who are falsely accused or financially crippled by unjust rulings.

    By standing together and refusing to participate in this injustice, we can send a strong message to lawmakers and society that these laws must change. Here’s why:

    1. Equality is a Two-Way Street
      Support and responsibility must be shared equally in relationships and after their dissolution. The current laws often place a disproportionate financial burden on men, ignoring the modern realities of shared responsibilities.
    2. Injustice Breeds Resentment
      These laws fail to account for cases where men are exploited or treated unfairly. This systemic bias needs to be addressed.
    3. Collective Resistance Leads to Change
      History shows that change happens when people stand together. By peacefully refusing to pay alimony and maintenance, even at the cost of imprisonment, we highlight the urgent need to reform these unjust laws.

    • Refuse to Pay: If the law mandates maintenance or alimony, make the conscious decision to resist.
    • Stand United: Support others who are part of this movement.
